All the quotes are valid only for a period of 15 days from the date of mailing / e-mailing / faxing.
The Client agrees to provide the text content, pictures and or any other required material to be used in the application.
Source Code of programs / applications is not part of the project deliverables unless specifically stated and is chargeable.
If a choice of design is presented, only one solution is deemed to be given by Schoolsindia as fulfilling the contract. All other designs remain the property of Schoolsindia, unless agreed in writing that this arrangement has been changed.
Schoolsindia will utilize its best efforts to maintain acceptable performance of services contracted for the various packages, but Schoolsindia makes absolutely no warranties whatsoever, express or implied, including warranty of merchantability or fitness for a particular purpose. Schoolsindia cannot guarantee continuous service, service at any particular time, or integrity of data stored or transmitted via its system or via the internet.
The time taken by the client to provide feedback and approval for designs are not included in the duration of the project.
Duration of Project completion may vary if feedback, approvals or required materials are not provided on time.
The client agrees to make available as soon as is reasonably possible to Schoolsindia all materials required completing the project to the agreed standard and within the set deadline.
Only copyrighted images will be used in the project. Images purchased for this project shall be billed.
Client hereby agrees that all media and content made available to Schoolsindia for use in the project are either owned by the Client or used with full permission of the original authors.
Schoolsindia cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
Client agrees that resale or distribution of any part or whole of the application/Design or any files is forbidden unless prior written agreement is made between the Client and the Company.
Client agrees to pass on FTP details and any other access details relating to their domain name and hosting account which the Developer requires to upload the web site / Application if required as part of a project.
Schoolsindia reserves the right without notice to cancel, reject or refuse work with domain names or hosting services without reason for such rejection or refusal.
The client is expected to test fully any application or programming relating to a site developed by Schoolsindia before being made generally available for use. Where "bugs", errors or other issues are found after the site is live, Schoolsindia will endeavor (but is not obliged to) to correct these issues to meet the standards of function
Any scripts, applications or software (unless specifically agreed) written by Schoolsindia remain the copyright of Schoolsindia and may only be commercially reproduced or resold with the permission of Schoolsindia.
Schoolsindia cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software / design is functioning correctly / error free before use.

When a client agrees that a site / Application / design can be made publicly available they are agreeing that the design and development of the site has satisfied all their requirements.
While we and our hosting partners take steps to ensure that client’s sites are always backed-up it is the client’s responsibility to take necessary backups of their site/application and related databases.
Schoolsindia will reserve the right to alter any of the above terms and conditions at any time.
The cost estimates agreed upon by Schoolsindia and Client are based on the requirements specified in the accepted proposal. Any change in the requirements or delays in communication will have a direct impact on the cost of the project
You agree that you will not use Schoolsindia Hosting Services for illegal purposes or for the transmission of material that is unlawful. You also agree that you will not use Schoolsindia Hosting Services for the transmission of material that is harassing, abusive, threatening, harmful, vulgar, obscene, or invasive of another's privacy. You agree not to use excessive CPU resources, using excessive disk space, attempting to gain access to root and other clients' accounts (hacking), installing continuously running programs, and reselling CGI scripts. You further agree that you are solely responsible for your content and you acknowledge that Advent acts as a passive conduit for the distribution and transmission of your data. You represent and warrant the content you provide to Advent (a) does not infringe on Advent's or any third party's intellectual property or proprietary rights or rights of publicity or privacy; (b) does not violate any law, statute, ordinance or regulation; (c) is not defamatory, trade libelous, pornographic or obscene; or (d) does not contain viruses or other similar harmful or deleterious programming routines. If you violate this provision you will be penalized up to and including termination of your rights to use the service and any other remedies available to Advent by law.
Schoolsindia cannot assure that emails generated from this website are free of errors, virus attachments, interception or interference.

Clients are requested to download the necessary files then and there and to keep the backup.
Schoolsindia won’t be responsible for any loss of data, due to negligence by the client.
Schoolsindia could charge extra fees to send the same data from our systems.
In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

Pricing / Payments:
A deposit is required from any new client before any work is carried out. It is the Schoolsindia policy that any outstanding accounts for work carried out by Schoolsindia or its affiliates are required to be paid in full, no later than 30 days from the date of the invoice unless by prior arrangement with Schoolsindia.
Once an advance amount has been paid to start the project, you / your company hereby agree to all the Terms & Conditions of Schoolsindia, which shall be updated from time to time in the website.
Charges for design services to be provided by Schoolsindia will be set out in the written estimate or quotation that is provided to the customer. At the time of the customer's signed acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 50% or any other percentage of the quoted fee will become immediately due. Work on the project will not commence until Schoolsindia has received this amount.
Pricing may vary according to the client’s demand for extra or special requirements or features.
Charges for any additional services / products over and above the estimated design, will become fully payable (100% of the quoted amount) at the time of estimate or quotation acceptance.
Schoolsindia have the right to revise the recurring pricing yearly depending on change in Internic / Web Server Costs at any time without prior notice
Strict adherence to the payment structure will enable Schoolsindia to provide prompt & effective service. Delayed payment or non-payment of recurring charges will lead to automatic account deactivation of service / products.
Taxes at present are nil. If the Government imposes direct / indirect taxes the same will be applicable over & above the quoted price.
All payments are to be made in the form of multi city At Par Cheque / Demand Draft – account payee in favor of Schoolsindia payable at Chennai. All payments are non-refundable.
Once a project has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e. if the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken if necessary.
Once a deposit is paid and work completed you are obliged to pay the balance of payment in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due.
If for some reason you wish to cancel or postpone your project after we have started work, we will bill you for design work completed to that point that your deposit does not cover; your initial deposit will be applied to that balance.
The paid amount will be credited to your project and we can pick up where we left off when you are ready to resume.
Schoolsindia will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents
The website, graphics and any programming code remain the property of Schoolsindia until defined agreement and all outstanding accounts are paid in full.
Schoolsindia reserve the right to alter our prices at any time without prior notice. If a quote at an original price has been made it will be valid for 15 days and subsequently during the life of the current commission, however additional work may be charged for using the new pricing structure.
A client’s site / design will be hosted once approval of the design and content is given however we reserve the right to remove the site / design at any time until the invoice is paid in full.
Publication and/or release of work done by Schoolsindia on behalf of the client, may not take place before cleared funds have been received.
Any payment returned by the bank will incur an INR.500 or US$.15 administration charge. This will be invoiced and will be added to the total outstanding debt owed by the customer.
Late payments will be priced at our rate of 18%. P.A.
No refunds will be given for hosting, domain registrations, servicing or updating packages cancelled during the current agreements time period.
The client is ultimately responsible for checking the correctness of the application/website before they give Schoolsindia the go ahead to make the application/website publicly available.
Change Requests:
All change requests are chargeable. Change requests are those which deviate partly/completely/directly/indirectly from the requirements specifications document.
It is absolutely the client’s responsibility to make sure the requirements specifications submitted by Schoolsindia meet the functional requirements required. Any change in requirements after the work has commenced and/or first installment is received will be treated as change requests
All change requests shall apply the specific hourly charges depending upon the work.
The customer agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge.
Complaints / Suggestions / Errors received after the specified maintenance period or 15 days from the completion of the project (if not mentioned) will be taken under Change Request.
Delays:
Schoolsindia takes best efforts to complete the project within the stipulated time.
However, if there is more than 10% delay in the timeline quoted, Schoolsindia is liable to reduce the project cost by up to 25% from the original project cost depending on the percentage of deviation from the original time line. For example, if the total project cost is INR 10000 and if there is a deviation of more than 25% in the time line, then the project cost is reduced by 25% and will be INR 7500.
Any deviations due to change requests or delay in approvals will not be considered as delay in completion
Whenever there is delay in approval or change requests, Schoolsindia will provide a new date of completion depending on the availability of resources at that time. This also depends on the nature and complexity of the change requests raised.
Complaint Procedure:
A formal complaint should be made in writing to Schoolsindia if any, who will acknowledge receipt and ensure that the matter is looked into as soon as possible.
Anyone who experiences a problem with their service provided by Schoolsindia should raise the matter directly using our e-mail given in the website, giving sufficient information to locate the material (such as a URL) and clearly outlining the grounds for complaint.
Schoolsindia will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.
The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.
An initial response to any complaint can be expected within seven days of its receipt.
All the disputes between the parties hereto including claims and interpretation of this Agreement shall be subject to the jurisdiction of Madras- INDIA.
Contest:
To be eligible to enter a Contest, you must be 18 years of age or younger
You must reside in India.
It is responsible of the School / Student / Teacher / Parent to ensure that you are not breaking any local or international or copyright laws.
All the drawings and essays are to be original product of a student
If found fake or copied, Schoolsindia reserves the right to exclude the material from the Contest.
Decision of the judges shall be final and binding to all.
All submitted material shall be properties of Schoolsindia.
Schoolsindia shall be Free to sue such material for any legitimate purpose as it may deem fit.
